Code of Ethics and Conduct

The Ethical Channel, or whistleblowing channel, is established as the means that allows employees, suppliers, customers, and other individuals or entities related to the organization or company in question to report incidents and irregularities regarding non-compliance with both internal regulations (ethical code) and external regulations with the aim of:

  • Complying with Law 10/2010 on the Prevention of Money Laundering and the Financing of Terrorism (art. 26 bis).

  • Meeting one of the minimum requirements established by the Penal Code for the exemption of criminal liability of the legal entity.

  • Providing a single channel for the exercise of rights and reporting in matters of Data Protection.

  • Ensuring the confidentiality of the communication, not disclosing to the client the personal data of the whistleblower in cases where the communications are not anonymous.

At this point, it’s important to highlight that the Attorney General’s Office, in Circular 1/2016, considers external Ethical Channels to be more efficient than those managed by the client themselves, as they involve less employee rejection, lower levels of “employee silence,” reduced risk of data leakage, and higher levels of confidentiality.

Therefore, having an ethical channel will help promote regulatory compliance and the ethical code of the organization. It will also create an atmosphere of trust that will allow for better management of good governance and transparency within the company.
